Outdoor Adventure Co – Website Terms & Conditions
Last updated: August 2026
These Website Terms & Conditions apply to your use of the Outdoor Adventure Co website and to purchases made through it.
Outdoor Adventure Co, ABN 84 958 722 942, is operated by A.T Bartlett & R.K Eustice (“Outdoor Adventure Co”, “we”, “us” or “our”).
Our website is available at outdooradventureco.com.au (“Website”).
By using our Website or placing an order with us, you agree to these Terms & Conditions.
These Terms should be read together with our:
- Shipping Policy;
- Returns & Refunds Policy; and
- Privacy Policy.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.
1. Using our Website
You may use our Website for lawful personal and commercial purposes consistent with these Terms.
You must not:
- use the Website for unlawful, fraudulent or malicious purposes;
- interfere with the operation or security of the Website;
- introduce viruses, malicious code or other harmful material;
- attempt to gain unauthorised access to the Website, accounts, servers or systems;
- scrape, copy or systematically extract Website content without our written permission, except where permitted by law;
- impersonate another person or provide deliberately false information;
- use the Website in a way that infringes another person’s intellectual property, privacy or other legal rights; or
- use our content or intellectual property in a way that falsely suggests an association with or endorsement by Outdoor Adventure Co.
We may restrict or suspend access to the Website where we reasonably believe this is necessary to protect our Website, customers, business or legal rights.
2. Eligibility to Purchase
You must be at least 18 years old, or have the consent of your parent or legal guardian, to place an order through our Website.
By placing an order, you confirm that the information you provide is accurate and complete.
3. Customer Accounts
You may be able to create a customer account, although an account may not be required to make a purchase.
You are responsible for keeping your login details secure and should notify us as soon as possible if you believe your account has been accessed without permission.
We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in serious breach of these Terms.
4. Products and Product Information
We aim to ensure that product descriptions, specifications, photographs, pricing and availability displayed on our Website are accurate.
However:
- photographs may vary slightly from the appearance of the actual product due to factors such as lighting, display settings or manufacturer updates;
- manufacturers may make minor changes to packaging, specifications or product appearance from time to time; and
- stock information may occasionally change before our Website has been updated.
Any material difference that affects a product’s identity, performance, intended use or compliance with its description remains subject to your rights under the Australian Consumer Law.
Where dimensions, weights, capacities or other specifications are described as approximate, reasonable manufacturing tolerances may apply.
5. Product Suitability and Outdoor Activities
Camping, hiking and other outdoor activities may involve inherent risks.
You are responsible for considering whether a product is appropriate for your intended activity, conditions, environment, experience and abilities.
Products should be installed, maintained and used in accordance with the manufacturer’s instructions, warnings and intended use.
Product descriptions, articles, guides and other general information provided through our Website are not a substitute for appropriate training, professional advice, safety planning or personal judgment where these are required.
Nothing in this section excludes or limits any rights or remedies available to you under the Australian Consumer Law.
6. Placing an Order
When you submit an order through our Website, you are offering to purchase the products in that order subject to these Terms.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted the order.
We may perform payment, fraud, stock and order-validation checks before accepting an order.
A contract for the purchase of a product is formed when we confirm acceptance of the order or arrange for the product to be dispatched, whichever occurs first.
7. Product Availability
Some products sold by Outdoor Adventure Co may be held and dispatched by third-party distributors, suppliers or fulfilment partners.
This allows us to offer a wider range of products, but it means stock information may sometimes change before our Website is updated.
We do not knowingly accept payment for products that we know we cannot supply.
If a product becomes unavailable after you place an order, we will contact you as soon as reasonably practicable.
Depending on the circumstances, we may offer:
- a suitable alternative, which you may choose whether to accept;
- fulfilment of the available products in your order;
- a revised delivery timeframe; or
- cancellation and a refund for the unavailable product.
We will not substitute a materially different product without your agreement.
8. Order Cancellation by Us
We may cancel all or part of an order before fulfilment where reasonably necessary, including where:
- the product is unavailable;
- an obvious pricing or product-listing error has occurred;
- payment cannot be processed;
- we reasonably suspect fraud or unauthorised payment activity;
- we are unable to deliver to the nominated address;
- an order breaches a stated quantity restriction;
- fulfilment would breach applicable law; or
- circumstances outside our reasonable control mean we cannot reasonably fulfil the order.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled product or order.
This does not limit your rights under the Australian Consumer Law.
9. Cancellation by You
If you wish to cancel an order, please contact us as soon as possible.
Where the order has not entered processing or fulfilment, we will generally be able to cancel it and issue a refund.
Once an order has entered fulfilment or been dispatched, we may be unable to cancel it. You may instead be able to return the product in accordance with our Returns & Refunds Policy.
10. Prices
Prices displayed on our Website are in Australian dollars unless otherwise stated.
Unless expressly stated otherwise, prices include GST where GST is applicable.
We may change prices at any time before an order is placed.
A price change will not affect an order that has already been accepted, except where an obvious pricing error has occurred and the law permits us to correct or cancel the affected order.
11. Pricing and Listing Errors
Despite our efforts, a product may occasionally be listed with an incorrect price, description, shipping cost or other information.
Where an error is obvious or significant, we may contact you before accepting the order to explain the issue and give you the opportunity to proceed on the corrected basis or cancel the affected item.
If an affected order cannot reasonably be fulfilled, we may cancel it and refund amounts paid for that item.
We will not use this provision to avoid supplying a product merely because we later decide that the agreed price was commercially unfavourable.
12. Payment
Available payment methods are displayed at checkout and may change from time to time.
Payments may be processed by third-party payment providers such as Stripe, PayPal or other payment services made available through our Website.
Your use of a third-party payment service may also be subject to that provider’s terms and privacy practices.
We do not ordinarily receive or store complete payment-card details where payment is processed directly by a third-party payment provider.
13. Fraud Prevention
We may use reasonable fraud-prevention and order-verification procedures.
Where an order is identified as potentially fraudulent, we may ask you to verify information associated with the order.
We will only request information reasonably necessary for verification and will handle personal information in accordance with our Privacy Policy.
We will not ask you to send us a complete copy of your payment card by email.
14. Shipping and Delivery
Shipping costs, available delivery methods and estimated delivery timeframes are described in our Shipping Policy and, where applicable, displayed at checkout.
Delivery estimates are estimates only unless we expressly agree to a guaranteed delivery date.
We will take reasonable steps to fulfil orders within the estimated timeframe.
If we become aware of a material delay, we will endeavour to notify you and provide an appropriate solution.
15. Delivery Address
You are responsible for providing a complete and accurate delivery address.
Please contact us promptly if you discover an error.
If an order has not yet entered fulfilment, we will make reasonable efforts to update the address.
Once an order has been dispatched, we may be unable to redirect it.
Additional delivery charges reasonably incurred because an incorrect or incomplete address was supplied may be payable by you, except where the error was caused by us.
16. Risk and Delivery
Risk in a product passes to you when the product is delivered to the delivery address nominated in your order, subject to any rights you have under applicable law.
Where you give a carrier authority to leave a parcel without attendance, the carrier may leave the parcel in accordance with that authority.
If an order is lost or damaged during delivery, please contact us so we can investigate and provide an appropriate remedy where required.
17. Returns, Refunds and Consumer Guarantees
Our Returns & Refunds Policy explains our voluntary change-of-mind policy and how we handle faulty, damaged, incorrect or otherwise non-compliant products.
Our voluntary returns policy operates in addition to your rights under the Australian Consumer Law.
Nothing in these Terms or our other policies excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
18. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Where a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund or compensation depending on the nature and seriousness of the failure and the requirements of the Australian Consumer Law.
A voluntary manufacturer’s warranty or Outdoor Adventure Co policy does not replace or restrict your Australian Consumer Law rights.
19. Third-Party Fulfilment
Some products may be stored, packed or dispatched on our behalf by third-party suppliers, distributors, warehouses or fulfilment partners.
Unless we expressly state otherwise before purchase, your purchase contract remains with Outdoor Adventure Co.
If there is a problem with an order fulfilled by one of our partners, please contact Outdoor Adventure Co rather than assuming you must resolve the issue directly with that partner.
We may communicate with the relevant supplier, distributor, manufacturer or carrier on your behalf in order to resolve the issue.
20. Third-Party Websites
Our Website may contain links to external websites or services.
A link does not necessarily mean that we endorse or control the third party or its content.
Except where required by law, we are not responsible for independent third-party websites or services and recommend reviewing their own terms and privacy policies before using them.
21. Reviews and User Content
You may be able to submit reviews, photographs, comments or other content through our Website or related channels.
You must only submit content that:
- you have the right to share;
- is truthful to the best of your knowledge;
- does not unlawfully infringe another person’s rights; and
- is not fraudulent, defamatory, threatening, malicious or unlawful.
By submitting content to us for publication, you grant Outdoor Adventure Co a non-exclusive, worldwide, royalty-free licence to reproduce, publish, format and use that content for our Website, social media, advertising and other business communications.
You retain ownership of your content.
We may moderate or remove content where we reasonably consider it unlawful, fraudulent, abusive, irrelevant, spam, or in breach of these Terms.
We will not suppress genuine negative reviews merely because they are unfavourable.
22. Intellectual Property
Unless otherwise stated, the Website and its original text, graphics, branding, logos, layout, photographs and other content are owned by or licensed to Outdoor Adventure Co and are protected by applicable intellectual-property laws.
You may view, download or print Website content for personal, non-commercial use.
You must not reproduce, republish, commercially exploit, alter or distribute our protected content without permission except where permitted by law.
Third-party product names, trademarks and images remain the property of their respective owners.
23. Website Availability and Security
We take reasonable steps to maintain the operation and security of our Website.
However, internet services can occasionally be interrupted or affected by technical faults, maintenance, malicious activity or circumstances outside our reasonable control.
To the extent permitted by law, we do not guarantee that the Website will always operate continuously or be free of every error, interruption or harmful component.
Nothing in this section limits rights that cannot lawfully be excluded.
24. Liability
Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful, including liability arising under the Australian Consumer Law where applicable.
To the maximum extent permitted by law, we are not liable for losses caused solely by:
- use of a product contrary to its instructions or intended purpose;
- unlawful or deliberate misuse of the Website;
- unauthorised modification of a product;
- a failure by you to take reasonable precautions appropriate to the circumstances; or
- circumstances for which the law permits liability to be excluded.
Where the law permits liability to be limited, our liability will be limited only to the extent that is fair, reasonable and lawful in the circumstances.
Nothing in these Terms is intended to exclude liability for personal injury, death, fraud, wilful misconduct or any liability that cannot lawfully be excluded.
25. Indemnity for Unlawful Use
You are responsible for loss reasonably suffered by us as a direct result of your deliberate unlawful conduct, fraud, or infringement of another person’s intellectual-property rights through content that you submit to our Website.
This provision does not require you to indemnify us for loss caused by our own negligence, breach of law or wrongful conduct.
26. Events Outside Our Reasonable Control
We are not responsible for delay caused by circumstances outside our reasonable control to the extent permitted by law.
These circumstances may include severe weather, natural disasters, transport disruption, industrial action, network or infrastructure failures, government action or unexpected supplier and carrier disruptions.
Where such circumstances affect an order, we will take reasonable steps to minimise the impact, keep you informed where practicable and provide a solution where required by law.
27. Privacy
Our collection, use and disclosure of personal information is described in our Privacy Policy.
28. Changes to These Terms
We may update these Terms from time to time, including to reflect changes to our business, Website, technology or legal obligations.
The version applying to an order is generally the version in effect when that order is placed.
Changes will not retrospectively remove rights already acquired under an existing contract or applicable law.
The current version will be published on our Website together with its last-updated date.
29. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue to operate.
30. No Waiver
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
31. Governing Law
These Terms are governed by the laws of Victoria, Australia.
You and Outdoor Adventure Co submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from them.
Nothing in this provision is intended to deprive a consumer of rights they may have under mandatory laws applicable to them.
